Terms of Use

These Terms of Use (the “Terms”) govern the relationship between the Operator and the user of the EchoDay mobile application and service (the “Service”).

By using the Service, registering, or continuing to use its features, the user confirms that they have read these Terms and the Privacy Policy, accept them, and agree to comply with them. If the user does not agree with the Terms, they must stop using the Service.

The Privacy Policy, which sets out how personal data is processed, is available at echoday.ru/en/privacy and forms an integral part of the rules for using the Service.

1. Operator and subject matter

These Terms cover access to the Service’s features: publishing and viewing video circles, reactions, comments (“echo”), follows, profile, as well as paid “Echo+” features and themed reaction packs.

2. Description of the Service

EchoDay is a social service for sharing short video circles about the user’s day and receiving responses from others.

core features are available free of charge with limits (including the number and length of circles per day);
extended features are offered via the “Echo+” subscription and by purchasing reaction packs in app stores;
the feature set may change; the Operator may update the Service without prior notice of every interface change.

3. Registration and account

Using the main features of the Service requires registration with a mobile phone number. Sign-in is confirmed by an incoming call (no password).

the user must provide accurate information and must not share account access with third parties;
a user may not create multiple accounts to bypass limits, moderation, or Service rules;
the user is responsible for actions performed through their account;
the Operator may restrict or block an account for breaches of the Terms or applicable law.

4. Age restrictions

The Service is intended for users aged 14 and over. By registering, the user confirms that they have reached the required age or use the Service with the consent of a legal representative where required by the law of the Russian Federation.

5. Conduct and prohibited content

The user agrees to use the Service in good faith and not to post materials that:

violate the law of the Russian Federation;
contain threats, incitement to violence, hate speech, or discrimination;
are pornographic, exploit minors, or otherwise violate children’s rights;
infringe intellectual property, honour, dignity, or business reputation of third parties;
contain malware, spam, fraud, or unsolicited advertising;
attempt to hack, scan, or disrupt the Service.

Harassment, insults, mass unwanted messaging, and circumventing technical limits are prohibited.

6. User content

The user retains rights to content they create (video circles, comments, avatar, and other materials) posted in the Service.

By posting content, the user grants the Operator a non-exclusive, royalty-free licence for the period the content remains posted, to the extent needed to operate the Service: storage, reproduction, display to other users, technical processing (including compression and thumbnails), moderation, and security.

The user warrants that they hold all rights needed to post the content and that posting does not infringe third-party rights.

The Operator may remove or restrict access to content that breaches the Terms or the law, including following a user report or a lawful request from authorities.

7. Intellectual property of the Service

Exclusive rights to the application, design, trademarks, logos, software, texts, and other elements of the Service (other than user content) belong to the Operator or other rightholders. Use of such elements without the Operator’s permission is prohibited, except as expressly allowed by the Terms or by law.

8. Paid features and “Echo+”

The “Echo+” subscription and themed reaction packs are purchased through app stores (RuStore, App Store, and others through which the app is distributed). Payment and refunds are governed by the store’s rules.

the Operator does not receive or store the user’s payment card details;
premium status and purchases are activated after the store confirms payment;
the Operator may change the paid feature set, prices, and offers; changes do not affect an already paid subscription period unless the store’s rules provide otherwise.

9. Moderation and reports

The Operator may moderate user content and accounts, including upon user reports, to enforce the Terms and applicable law.

A user may report another user’s content or behaviour via the Service or by emailing info@iluhin.pro. The Operator reviews reports within a reasonable time but does not guarantee a particular outcome in every case.

10. Limitation of liability

The Service is provided “as is”. The Operator strives for reliable operation but does not guarantee uninterrupted availability, freedom from errors, or full compatibility with all devices.

the Operator is not liable for user content or users’ actions;
the Operator is not liable for network failures, app stores, the user’s devices, or third-party acts;
to the extent permitted by law, the Operator’s liability is limited to the amount actually paid by the user to the Operator for paid features in the preceding 12 months (if applicable), or the minimum amount required by law.

11. Suspension and termination

The user may stop using the Service at any time, including by deleting the account in the Service or by emailing info@iluhin.pro.

The Operator may temporarily restrict or block access to an account or features for breach of the Terms, suspected abuse, legal requirements, or threats to the security of the Service and its users.

12. Changes to the Terms

The Operator may amend these Terms. The current version is always available on this page with the effective date. Continued use of the Service after publication of changes means the user accepts the updated Terms. Material changes affecting user rights will, where practicable, be reflected on the website and/or in the app.

13. Governing law and disputes

These Terms and use of the Service are governed by the law of the Russian Federation. Disputes shall be resolved by negotiation and, failing that, under the law of the Russian Federation at the Operator’s location, unless mandatory rules provide otherwise.
